In compliance with LSSI-CE (Ley 34/2002), Real Decreto Legislativo 1/2007, EU Consumer Rights Directive 2011/83/EU, and applicable Spanish and EU law.

1. General:

These Terms and Conditions govern the commercial relationship between The Coffee Canvas (Michael Wolf, NIF: Z1922196E, Calle Gran Capitán, 80 | 04003 | Almería | Spain) and any person or entity placing an order through www.thecoffeecanvas.com or via direct communication. By placing an order, the customer accepts these Terms and Conditions in full.

2. Pre-Contractual Information (EU Consumer Rights Directive 2011/83/EU):

In compliance with Article 6 of the EU Consumer Rights Directive 2011/83/EU, the following information is provided to all customers before a contract is formed:

  • Description of goods: Custom-printed drip coffee bags, personalised to your specifications

  • Total price: Confirmed in the written quote provided within 24 hours of your order request, inclusive of 10% VAT

  • Delivery costs: Free to mainland Europe; surcharges may apply to islands and remote areas - communicated before order confirmation

  • Payment terms: Specified in the individual quote

  • Delivery timeframe: Approximately 2 to 4 weeks from design approval and order confirmation (depending on quantity and designs)

  • Right of withdrawal: Applies to consumer customers only, before production commences; does not apply once production of personalised goods has started (see Section 9)

  • Complaint handling: Contact hello@thecoffeecanvas.com; EU ODR platform available at https://ec.europa.eu/consumers/odr

  • Applicable law: Spanish law, with mandatory EU consumer protections applying where applicable

3. Order Process:

3.1. Orders are initiated by submitting the order request form on this website. Submission of the form constitutes an expression of interest and does not create a binding contract.

3.2. The Coffee Canvas will send a personalised quote to the customer within 24 hours of receiving the order request. The contract is formed when the customer expressly accepts the quote in writing (by email or other written means) and The Coffee Canvas confirms acceptance.

3.3. The Coffee Canvas reserves the right to decline any order request at its sole discretion.

4. Design and Proof Approval:

4.1. Following order confirmation, The Coffee Canvas will prepare a digital proof of the bag design for the customer's approval.

4.2. Production will not begin until the customer has provided written approval of the digital proof.

4.3. The customer is responsible for verifying that all design content (text, logos, colours) is accurate and correct before approving the proof. The Coffee Canvas accepts no liability for errors in the approved design.

4.4. The customer warrants that they hold all necessary intellectual property rights or licences for any logo, image or content submitted for printing. The Coffee Canvas accepts no liability for intellectual property infringement arising from customer-submitted content.

5. Pricing and Payment:

5.1. All prices shown on the website include 10% VAT unless otherwise stated.

5.2. The final price will be confirmed in the written quote provided by The Coffee Canvas. Prices are subject to change until a quote is formally accepted.

5.3. Payment terms will be specified in the quote. The Coffee Canvas reserves the right to require full or partial payment in advance before production begins.

5.4. In the event of late payment, The Coffee Canvas reserves the right to suspend production or delivery until full payment is received.

6. Delivery:

6.1. The Coffee Canvas offers free delivery to mainland Europe. Deliveries to islands (including the Canary Islands, Balearic Islands, Azores, Madeira, and other EU island territories) and remote areas may incur a surcharge, which will be communicated to the customer before order confirmation.

6.2. Estimated delivery times will be specified in the quote. Standard delivery is approximately 2 to 4 weeks from the date of design approval and order confirmation. The Coffee Canvas will make every reasonable effort to meet agreed delivery dates but cannot guarantee delivery times due to circumstances beyond its control (e.g. carrier delays, force majeure).

6.3. Risk of loss or damage passes to the customer upon delivery to the address specified in the order. For consumer customers, risk passes upon physical receipt of the goods by the consumer or a third party designated by the consumer, in accordance with EU Consumer Rights Directive 2011/83/EU Art. 20.

6.4. The customer must inspect the goods upon delivery and notify The Coffee Canvas in writing within 5 business days of receipt of any defects, shortages or non-conformities. Failure to notify within this period constitutes acceptance of the goods.

7. Quality and Defects:

7.1. The Coffee Canvas guarantees that all products are produced in accordance with the approved design proof and meet reasonable quality standards for specialty grade coffee drip bags.

7.2. In the event of a proven manufacturing defect or significant deviation from the approved proof, The Coffee Canvas will at its option: replace the defective goods, offer a credit note, or issue a partial or full refund. The customer must provide photographic evidence of the defect within 5 business days of receipt. For B2B customers, The Coffee Canvas reserves the right to require the return of all defective goods at The Coffee Canvas' cost before issuing a replacement or refund. For consumer customers, return of goods may be requested by The Coffee Canvas at The Coffee Canvas cost, but a refund or replacement will not be unreasonably withheld pending return where return is impractical due to the nature of the goods.

7.3. Minor variations in colour reproduction between the digital proof and the printed product are inherent to the printing process and do not constitute a defect.

8. Cancellations:

8.1. Orders may be cancelled by the customer at no charge before the digital proof has been approved and before production has commenced.

8.2. Once production has commenced, cancellation is not possible and the full order value remains payable.

8.3. The Coffee Canvas reserves the right to cancel an order in exceptional circumstances (e.g. supply chain issues, force majeure). In such cases, any payments received will be fully refunded within 14 days.

9. Business Customers - Limitation of Consumer Rights:

9.1. The Coffee Canvas' services are primarily directed at business customers (B2B). Where the customer is acting in the course of a business, trade or profession, the statutory consumer rights under Real Decreto Legislativo 1/2007 and EU Consumer Rights Directive 2011/83/EU (including the 14-day right of withdrawal) do not apply.

9.2. Where the customer is a private individual acting outside the scope of any business or profession (consumer), the statutory rights set out in Section 10 below apply in full.

10. Consumer Rights (Private Individuals Only):

10.1. If you are a consumer (a private individual acting outside the scope of any business), you have the right to withdraw from this contract within 14 calendar days of order confirmation, without giving any reason, provided that production has not yet commenced.

10.2. To exercise your right of withdrawal, you must notify The Coffee Canvas at hello@The Coffee Canvas.com before the end of the 14-day period. Upon valid withdrawal, any payments made will be refunded within 14 days using the same payment method used for the original transaction.

10.3. The right of withdrawal does not apply to goods that are clearly personalised or custom-made to your specifications, in accordance with Article 103(c) of Real Decreto Legislativo 1/2007 and Article 16(c) of EU Consumer Rights Directive 2011/83/EU. Once production of your personalised order has commenced, the right of withdrawal is lost.

10.4. Consumer customers in other EU member states retain the benefit of any mandatory consumer protection provisions of their country of residence that are more favourable than those set out herein, to the extent required by EU law.

11. Limitation of Liability:

11.1. The Coffee Canvas' total liability to the customer under or in connection with any order shall not exceed the value of that order.

11.2. The Coffee Canvas shall not be liable for any indirect, consequential or special damages, including loss of profit, loss of business or reputational damage.

11.3. Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Intellectual Property

The Coffee Canvas retains all intellectual property rights in its designs, branding and website content. Custom designs created specifically for a customer are the intellectual property of that customer upon full payment.

13. Dispute Resolution:

In the event of a dispute, The Coffee Canvas commits to seeking an amicable resolution in the first instance. Customers may contact The Coffee Canvas at hello@thecoffeecanvas.com. If no resolution is reached, disputes shall be governed by Spanish law and submitted to the competent courts of Almería, Spain. Consumer customers in other EU member states may also bring proceedings in the courts of their country of residence. As required by EU Regulation 524/2013, consumers may access the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

14. Modifications:

The Coffee Canvas reserves the right to update these Terms and Conditions at any time. The version in force at the time of each order shall apply.

15. Excise Duties and Local Taxes on Coffee:

15.1. Coffee is subject to national excise duties in certain EU member states, including but not limited to Germany, Greece, Belgium, Denmark, Latvia and Croatia. These duties are separate from VAT and are governed by the domestic legislation of each member state.

15.2. Where the customer is a business (B2B) taking delivery of goods in a country where a coffee excise duty applies, the customer acknowledges that they may be liable for declaring and paying any applicable excise duties to their national tax authority in accordance with their local law. The Coffee Canvas' prices do not include any such duties.

15.3. The Coffee Canvas will make reasonable efforts to inform customers of known excise duty obligations relevant to their delivery country. However, it is the customer's responsibility to verify the excise duty rules applicable in their country and to ensure compliance with all relevant tax obligations prior to placing an order.

15.4. The Coffee Canvas accepts no liability for any penalties, fines or additional costs arising from the customer's failure to comply with applicable excise duty obligations in their country of delivery.

15.5. Germany specifically: Customers taking delivery of coffee in Germany are advised that the German Coffee Tax Law (Kaffeesteuergesetz) imposes specific obligations on both importers and recipients of coffee. Business customers receiving coffee shipments in Germany are responsible for ensuring compliance with German customs and tax authorities. The Coffee Canvas reserves the right to require written confirmation of the customer's compliance arrangements before fulfilling orders destined for Germany.
